To ensure the independence o+ jud ic i a l guarantee of human r ights 中国宪法与人权 ．．纲 要 本文在阐述宪法有关人权的几个基本问题及我国宪法在人 权保障上的主要成就，存在的问题的基础上，从政治、经济、 义化方面探寻宪法保障人权不足的原因，并提出思考： 一．宪法中有关人权的几个基本问题 1．人权的界定 2．人权的主体 3．人权的体系 4．入权的权利状态 二．宪法在人权保障上的成就，存在的问题 1．主要成就 门）我国人权宪法保障的历史运演功程 Q）现行宪法之设计及内容对人权保障的体现 Q）实施宪法获得人权保障方面的成就 工 存在的问题 门）政治方面 宪法中有关公政治权利的规定尚存在“空白”，如 4 ．M 没有规定罢工自由。另外，宪法的规定原则、抽象，需 要具体的法规或制度相配辅。 u）经济方面 受我国经济发展水平的制约，有的权利无法得到宪 法的承认，如迁徙权。 门）环境方面 我国在发展经济的同时也注重环境保护，但公民的 环境权尚没有得到宪法的确认。 三．宪法在人权保障上存在不足的原因 门）政治方面 对国家权利的极端不信任是宪法最初产生的根源。 尽管我国政府代表人民的利益，但由于宪法对权利的约 柬原则，不可能涉及具体操作规程，因此需要设置权利 丁 的击约机击。 Q）经济方面 宪法反映了经济发展的客观要求。中国特色的市场 经济体制需要与之相配套的法律体制，建立与市场经济 体制相适应的宪法体系是个宏大的工程体系。 5 门）文化方面 ， 封建的人治思想与传统的义务本位观念深切影响 卜 人们的思想，成为普遍树立入权意识的主要障碍。 四．几点思考 1．赋予宪法权威，提高整体民众的人权意识 2．加强立法保护，建立中国特色的人仅保障体系 3．确保司法独立，完善人权的司法保障机制
